1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Neura Fringe Car Rentals ("Company," "we," "us," or "our") concerning your use of our car rental services and website.

By accessing our website, making a reservation, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Eligibility and Requirements

2.1 Age Requirements

• Minimum age: 21 years for standard vehicles
• Minimum age: 25 years for luxury and premium vehicles
• Young driver surcharge applies to drivers aged 21-24

2.2 License Requirements

• Valid UK driving license held for minimum 1 year
• International driving permits accepted with valid foreign license
• No major driving violations within the past 3 years
• License must be presented at time of rental pickup

2.3 Credit Requirements

• Valid credit card in the renter's name required
• Debit cards accepted with additional verification
• Security deposit will be authorized on payment method

3. Rental Agreement

3.1 Reservation Process

Reservations can be made through our website, phone, or in person. All reservations are subject to vehicle availability and final confirmation.

3.2 Rental Period

• Minimum rental period: 24 hours
• Late returns subject to additional charges
• Early returns do not qualify for refunds
• Extensions must be approved in advance

3.3 Vehicle Pickup and Return

• Vehicles must be picked up during business hours unless arranged otherwise
• Renter must inspect vehicle and report any existing damage
• Vehicles must be returned with same fuel level as provided
• Return outside business hours may incur additional fees

4. Fees and Payment

4.1 Rental Fees

• Daily rental rate as quoted at time of reservation
• Mileage charges if applicable
• Insurance and protection plans (optional)
• Additional driver fees
• Young driver surcharge (ages 21-24)

4.2 Additional Charges

• Fuel service charge if returned without full tank
• Late return fees (£25 per hour)
• Cleaning fees for excessively dirty vehicles
• Smoking fee: £200
• Lost key replacement: £150
• Traffic violations and fines

4.3 Security Deposit

A security deposit will be authorized on your payment method at the time of rental. The amount varies by vehicle class and will be released upon satisfactory return of the vehicle.

5. Insurance and Liability

5.1 Basic Coverage

All rentals include basic third-party liability insurance as required by UK law. This covers damage to third parties but not damage to the rental vehicle.

5.2 Optional Protection

• Collision Damage Waiver (CDW): Reduces liability for vehicle damage
• Theft Protection: Coverage against vehicle theft
• Personal Accident Insurance: Medical coverage for occupants
• Personal Effects Coverage: Protection for personal belongings

5.3 Exclusions

Coverage does not apply to damage caused by:

• Violation of rental terms
• Driving under the influence
• Unauthorized drivers
• Off-road driving
• Negligent or reckless operation

6. Vehicle Use Restrictions

6.1 Prohibited Uses

The rental vehicle may not be used for:

• Commercial purposes without prior approval
• Racing, speed contests, or driving instruction
• Transportation of hazardous materials
• Off-road driving or on unpaved roads
• Transportation outside of the UK without permission
• Any illegal activities

6.2 Authorized Drivers

• Only drivers listed on the rental agreement may operate the vehicle
• Additional drivers must meet eligibility requirements
• Additional driver fees apply
• Spouse of primary renter may be covered without additional fee in some cases

7. Cancellation and Modifications

7.1 Cancellation Policy

• Free cancellation up to 24 hours before pickup time
• Cancellations within 24 hours: 50% of first day's rental charge
• No-show reservations: Full first day charge
• Prepaid reservations may have different cancellation terms

7.2 Modifications

Reservation changes are subject to availability and may result in rate changes. Modifications should be made as early as possible to ensure availability.

8. Damage and Accidents

8.1 Reporting Requirements

In case of an accident or damage:

• Contact emergency services if there are injuries

• Do not admit fault or liability
• Obtain police report if required
• Complete incident report form
• Take photos of damage if safe to do so

8.2 Liability

Renter is responsible for all damage to the vehicle not covered by insurance, including but not limited to collision damage, theft, vandalism, and weather-related damage.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Limitation of Liability

To the maximum extent permitted by law, Neura Fringe Car Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of our services.

11. Indemnification

You agree to indemnify and hold harmless Neura Fringe Car Rentals from any claims, damages, losses, or expenses arising from your use of the rental vehicle, including but not limited to traffic violations, accidents, and damage to third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the effective date. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
